Contrast between CESMM3 and CESMM4


Major difference between CESSM3 and CESSM4 is CESSM4 has a neutral status with regards to the Specification and Contract. It means generally there are no particular Conditions of Contract or Specification for the CESMM4. Therefore CESMM4 can be used with any conditions of contract and National Standard.

CESMM3 has defined “ICE Conditions of Contract” as the Conditions of Contract (Definition 1.2). However CESSM4 hasn’t referred particular conditions of contract. Mandatory schedule in the Preamble has introduced to fill the gap.  Purpose of the schedule is to avoided any discrepancies or ambiguities between the Conditions of Contract and Method of measurement by identifying the relevant clauses in the schedule. For an example refer Clause 6.4.

CESMM3 – For the purpose of clause 60 interim additions or deductions on account of the amount ……

CESMM4 – For the purpose of interim payments additions or deductions on account of the amount ……

Above clause 6.4 of removed the reference to ICE Conditions of Contract and asked to identify the relevant clause nr in preamble schedule.


Generally CESSM3 is referred to British standard (Definition 1.15) nevertheless CESSM4 is generally in neutral status. For an example refer below additional rules A1 of class J.

CESSM3 - The material, joint types, nominal bore and Lining requirements of pipe fittings shall be stated in the item description and reference given to applicable British Standard specifications and specified qualities.

CESSM4 - The material, joint types, nominal bore and Lining requirements of pipe fittings shall be stated in the item.

However there are two exceptions for the rule due to impracticability of producing BoQ’s without referring to British standards. Those are Concrete mixture and Road construction. However if the referred British standards is not the one relevant to the project, bill compiler should mentioned the relevant standard in the schedule in preamble.

CESSM4- D1. Items for the provision of concrete shall be classified in accordance with BS 8500 and (November 2006) BS EN 206-1.

If BS 8500 is not the standard relevant to a particular project, bill compiler should mention the relevant standard in item 8 –Class F Definition rule D1.

Also each class has a row which hasn’t allocated for any item. Intention of this may be to measured items where CESMM is comprehensive with the CESMM code reference 999.
Other than those key changes, there are many changes and new items that can be notices in CESMM4. Few of those are listed below.

DISPUTE RESOLUTION MECHANISUMS IN QATAR LABOUR LAW

INTRODUCTION

Law No (14) of the Year 2004 is the Qatar Labour law. The Law is applicable for every Labours and Professionals including Quantity Surveyors. It has described most significant areas related to employees in sixteen parts, namely;

Dispute resolution is one important area for Quantity Surveyors. They advice clients regarding construction disputes and moreover they may practice as Adjudicators, Mediators and Arbitrators. Nevertheless, he also in a risk to subject to disputes with his employers and Clients.

Hence it is important to know the applicable law for QS's working in Qatar in relation to labour dispute resolution.

Aim of this article is to discuss the labour dispute resolution mechanisms available in the Laws.

As I discuss in “Dispute resolution mechanism”, there are several types of Dispute resolution mechanisms available in the world such as Negotiation, Mediation, Conciliation, Mini trial, Arbitration and Litigation.

In the Law has adopted following Dispute resolution mechanisms for labour disputes resolution.

1) Negotiation

2) Mediation

3) Conciliation

4) Arbitration

NEGOTIATION

According to the Article 129 any disputes between employer and workers shall try to settle by themselves.

“If any dispute arises between them and some or all of his workers the two parties to the dispute shall try to settle it between themselves ....”

MINI TRIAL

Article 129 states, in case of a dispute between employer and workers, if there is a joint committee in the company, they can be referred the case to the committee. Joint committee hasn’t address in the Law in detail; however this would be similar to the Mini Trial approach.

“If there is a joint committee in the establishment the dispute shall be referred to it for settlement.”

MEDIATION

If above two mechanisms failed then the next step is Medication.

According to the article 129, workers shall submit complaint in writing to employer with a copy to the labour department and the employer shall reply in written to the worker within one week, with a copy to the department. If the reply does not resolve the dispute department will try to settle it through Mediation within 15 days.

“1. The workers shall submit their complaint or claim in writing to the employer with a copy thereof to the Department.

2. The employer shall reply in writing to the complaint or claim of the workers within a week from his receiving the same and shall send a copy of the reply to the Department.

3. If the reply of the employer does not lead to the settlement of the dispute the Department shall try to settle the dispute through its mediation.”

CONCILIATION

If they fail to bring both parties in to a common ground within 15 days, then the department should submit the dispute to a Conciliation committee.

“If the mediation of the Department does not lead to the settlement of the dispute within fifteen days from the date of the employer's reply the Department shall submit the dispute to a conciliation committee for its decision thereon.”

According to the article 130, the Conciliation committee shall comprise 3 members. One shall nominate by the employer and other by the workers. Chairman of the committee shall be appointed by the Minister. The committee have authority to get assistant of a specialized consultant to make a decision. The committee shall give its decision within a week and it shall be binding on the all parties, if they had agreed to refer the dispute to the committee.

“The committee may be assisted by consultation with any of the specialists before deciding on the dispute and shall issue its decision on the dispute within a week from the date of its submission thereto.

“The decision of the committee shall be binding on the two parties to the dispute if the parties had agreed in writing to referring the dispute to the committee before its meeting to decide on the dispute and ....”

ARBITRATION

If parties have agreed to refer the dispute to arbitration, the above conciliation step is not applicable and the dispute will directly refers to an arbitration procedure.

“.... and if there is no such an agreement in this respect the dispute shall be referred to an arbitration committee within fifteen days and the arbitration shall be mandatory for the two parties.”

According to the article 131, the Arbitration committee shall be formed under the presidency of a Judge. One member is a representative of the workers and others, a representative of Qatar Chamber of Commerce and a representative of the Ministry.

According to the article 132, the committee shall render final awards on majority basis. However in case of equality of votes the chairman of the committee shall have a casting vote. Committee can review documents and conducts hearing before they make the award.

The committee in carrying out its duties may peruse all papers, documents and all evidence and may compel any- person possessing these papers, documents and evidence are to produce the same and may enter the establishment for conducting necessary inquiry and take all necessary procedures for settling the disputes.”

Until the dispute settle, both parties shall continue their duties and responsibilities. It has clearly mentioned in article 133.

“An employer may not close the place where he is employing the workers or stop the work or refuse to continue to employ any worker by reason of a dispute that has not been decided on by the conciliation or arbitration committee.”

It is a good movement, that Qatar has totally depends on Alternative Dispute Resolution methods rather than traditional litigation with regarding labour disputes. There is no information regarding the cost of dispute resolution in the act.

Q & A

Scenario:

Mr.Bhathiya practised as a Quantity Surveyor in Qatar for ALEC Contracting Limited. He got an accident and admitted to the hospital. He discharged from the hospital and return back to home after 2 weeks from the accident. He has informed to the ALEC, that he is still not well and needs another additional 2 weeks for rest as sick leave since already he finished his all sick leaves. However ALEC has rejected his request and asked him to report to the office. Mr.Bhathiya also refuses the company’s request.

Finally the contract was terminated by the company. After the termination, other employees planned to go on strike against the termination.

1. Can Mr.Bhathiya refuse to come for work by refusing company’s request?

According to the article 112 such disputes (dispute arises between the worker and the employer as to the ability of the worker to resume his work) shall refer to the competent medical authority and their decision shall be final.

2. Can employees go on strike?

Yes. But under certain circumstances and subject to approval of the committees.

“Workers are allowed to form a committee if there are at least 100 Qatari workers in the company. The Labour Law also contains provisions allowing workers to go on strike under certain circumstances and subject to approval of the committees. While this may afford some protection for rights of workers in certain large organisations and industries, those who are employed in small businesses or in trades that almost exclusively employ foreign workers would not be eligible to form such a union or committee.1

In 2010 September, 90 labourers were arrested by the police and deported for strike against their company that violated an agreement with them2.

වෘත්තිය නොසැලකිල්ල (Professional negligence)


රාජකාරි කටයුතුවලදි වෘත්තිකයන් අතින් වැරදි සිදුවිම ස්වභාවික දෙයකි. එම වැරදි හේතුවෙන්වෘත්තිකයාගෙන් සේවය ලබාගන්නා අයට යම් අලාභයක් සිදුවුවහොත් එය එම වෘත්තිකයාගෙන් අයකරගැනිමට නිති පවති. ඉංග්‍රිසි නිතියේ දිලික්ත නිතිය (English law of tort) යටතේ වෘත්තිය නොසැලකිල්ල(professional negligence) ලෙසින් නොසැලකිල්ල (negligence) යන කොටස උප කොටසක් ඇත්තේ ඒ සදහාය.

වෘත්තිකයා විසින් තමන්ගේ දැනිමේ ආකාරයට තම සේවාදායකයාට අලාභයක් නොවන ලෙස තම වෘත්තිය සේවාව ලබාදිය යුතුය. එය තම සේවාව පිලිබදව ඇති සැලකිල්ල (duty of care )ලෙස හැදින්වේ.

යම් අයෙකු, වෘත්තිකයෙකු සමග ඔහුගෙන් සේවාවක් ලබාගැනිම පිණිස ගිවිසුමකට එලබෙන විට,පැහැදිලිව සදහන්කල නියමයන් (express term ) නැතද එයතුලින් ගම්‍යවන නියමයක් (implied term )වන "සේවාව සාධාරණ සැලකිල්ලකින් (reasonable care) හා දක්ශතාවයකින් (skill ) යුතුව ලබාදිය යුතුය" යන්න මුල් කරගෙන යම් අලාභයක් සිදු වුවහොත් නිති මාර්ගයෙන් කටයුතු කල හැකිවේ.

මෙම නඩුවේදි පැමිණිලිකරු වුයේ දරුවන් පස්දෙනෙකුගේ පියාවු දුම්රිය දෙපාර්තුමේන්තුවේ මුරකරුවෙකි. ඔහුත්, ඔහුගේ බිරිදත් නැවත දරුවන් නොවැදිමට තිරණයකර ශල්‍යවෙද්‍යවරයෙකුගේ උපදෙස් පතා ඇත. ඔහු විසින් වාසෙත්කම් (vasectomy ) සැත්කම කිරිම තුලින් ස්ථිර වදභාවයට(permanently sterile) පත්වම බව ප්‍රකාශකර ඇත. සැත්කම සිදුකෙරිනි. එහෙත් පසුව Thake මහත්මිය ගැබිගත් අතර පසුව දියණියක වැදුවාය.

මෙහිදි ශල්‍යවෙද්‍යවරයා හා Thake මහත්මිය ගිවිසුමකට බැදුනේ හුදෙක් සැත්කම සිදු කිරිමට පමණක්ම නොවේ ඇය එම සැත්කම කිරිම තුලින් සම්පුර්ණ වද භාවයට පත් කිරිමේ එකගතාවයද සමගය.

මෙහිදි උසාවිය Thake මහත්මියට දරු උපත වෙනුවෙන් වැයවු මුදල් හා ඇයගේ වැටුප අහිමි විමෙන් සිදුවු පාඩුව ගෙවන ලෙස නියෝග කල අතර ඇයට සිදුවු වේදනාව හා කණගාටුව වෙනුවෙන් ගෙව්ම අනවශ්‍ය යැයි තිරණය කලේ දරු උපතේදි දැනෙන සතුට සැලකිල්ලට ගනිමිනි.

නොසැලකිල්ල යටතේ ගොනු කල නඩුවකදි ඔප්පු කල යුතු මුලිකාංග.

1) රාජකාරිය (Duty)

2) එම රාජකාරිය කඩ කෙරුණු බව (Breach)

3) එයට නියම හේතුව (Actual cause)

4) ආසන්නතම හේතුව (Proximate cause)

5) සිදුවු අලාභය (Damages)

ප්‍රමාණ සමික්ශකයින් සදහා වැදගත් නඩු - මුත්තුට එරෙහි බෝදිල්

 විෂය රදවාගැනිමේ මුදල් (Retention)


කොන්ත්‍රත්කරුට ගෙවිම සදහා නිර්දේශවු මුදලින් රදවාගැනිමේ මුදල්(Retention money) අඩු කිරිමේ බලය JCT කොන්ත්‍රත් ක්‍රමයේදි ලබාදි ඇත.

මෙම රදවාගැනිමේ මුදලින් (Retention money) අඩක් කොන්ත්‍රත්කාලය නිමවු පසු කොන්ත්‍රත් කරුට  ගෙවනු ලබයි.ඉතිරි මුදල වගකිම් කාලය (Defects correction period ) අවසානයේදි කොන්ත්‍රත්කරු වෙත ගෙවනු ලැබේ. මෙහිදි එම මුදල්ගෙවන්නේ, කොන්ත්‍රත්කරුගේ වරදක් නිසා යම් දෝශ(defects) ඇතිවි ඇත්නම් ඒවා නිවරදි කිරිමෙන් අනතුරුවයි.

 මෙසේ රදවාගැනිමේ මුදල්( Retention money), රදවා තබා  ගැනිමේදි ඒවා ගෙවිමට සේවායෝජකයාට නොහැකි වුවහොත් (Insolvent), කොන්ත්‍රත් කරු එම මුදල් නොලැබිමේ අවදානමකට ලක්වේ.

  මුදල් ගෙවිමට අනුමතවු දිනයේදි කොන්ත්‍රත්කරු විසින් රදවා ගැනිමේ මුදල්(Retention money) වෙනම බැංකු ගිණුමක තැම්පත් කරන ලෙස සේවායෝජකයාගෙන් ඉල්ලා සිටිය හැක.එය කොන්ත්‍රත්කරුවන්ගේ ආරක්ශාව උදෙසා JCT පනවා ඇති කොන්දේසියකි.

 බෝදිල්ට එරෙහි මුත්තු නඩුවේදි බෝදිල්(කොන්ත්‍රත්කරු) හා මුත්තු(සේවායෝජකයා) ලෙයිචෙස්ටර්(Leicestershire) හි නව මහල් නිවාසයක් ගොඩ නැගිම සදහා ගිවිසුමකට එලෙබෙන ලදි.

මෙම කොන්ත්‍රත්තුව JCT සම්මත ගොඩනැගිලි කොන්ත්‍රත් ක්‍රමයට අනුව එලබෙන ලද්දකි.

ව්‍යාපෘතිය 2007 පෙබරවාරි 12 දින නිමකිරිමට නියමිතව තිබුණද එය නියමිත කාලයතුල නිමකිරිමට කොන්ත්‍රත්කරුට නොහැකිවිය.2007 පෙබරවාරි 12 දින යුරෝ 124,207ක රදවාගැනිමේ මුදලක්ද(Retention) ඇතුලුව යුරෝ මිලියන 3.97ක මුදලක්  අනුමත්ව තිබුණි.

 රදවාගැනිමේ මුදල් නියමිත ආකාරයෙන් ගෙවන බවට කොන්ත්‍රත්කරුට හා වාස්තුවිදයාඥයාට සහතික කිරිමට, රදවාගැනිමේ මුදල් තැම්පත් කිරිම සදහා වෙනම බැංකු ගිණුමක්  ආරම්භ කිරිම JCT කොන්ත්‍රත් ක්‍රමයේ එක් නියමයකි. එහිදි එම බැංකු ගිණුමට හිමිවන පොලිය හිමි වන්නේ සේවායෝජකයාටයි.

 රදවාගැනිමේ මුදල්හි ආරක්ශාව සදහා ඇති මෙම ක්‍රමයෙන් ප්‍රයෝජන ගැනිමට බෝදිල් එතරම් උනන්දුවක් දැක් වුයේ නැත.2007 සැප්තැම්බර් මස   අගදි මුත්තුගෙන් මුදල් ගෙවිම සදහා වෙනම බැංකු ගිණුමක් ආරම්භ කරන ලෙස ඉල්ලා සිටින ලදි. 

ඉලග මාසයේදි මුත්තු විසින් බැංකුවෙන් වෙනම බැංකු ගිණුමක් ආරම්භකරන ලෙස ඉල්ලා සිටියේ රදවාගැනිමේ මුදල් එම බැංකු ගිණුමේ තැම්පත් කරන අදහසිනි(Intention).

එහෙත් බැංකු ගිණුම විවෘත කිරිමට බැංකුව ප්‍රමාදවු අතර ඒයින් නොඉවසිලිමත්වු බෝදිල් අධිකරණය හමුවට ගියේ කොන්ත්‍රත්තුවේ සදහන්  නියමයන්ට අනුව කටයුතු සිදුවිය යුතුබවට අධිකරණයෙන් සහතිකයක් ලබා ගැනිම සදහාය. 

මෙම කාරණාවේදි ගරු අධිකරණයේ මතය වුයේ කොන්ත්‍රත්කරු විසින් සේවායෝජකයාගෙන් රදාවාගැනිමේ මුදල් තැම්පත් කිරිම සදහා වෙනම බැංකු ගිණුමක් විවෘත කරන ලෙස ඉලා සිටිය විට එය ඉටුකිරිම සේවායෝජකයාගේ යුතුකමක් බවයි.

 එහෙත්, කොන්ත්‍රත්තුවේ  හෝ සාමානය නිතියේ මෙය ක්ශනිකව සිදුකල යුතු බව දක්වා නැත.

වාණිජමය කාරණා සලකා බැලු අධිකරණය මෙසේ ඉල්ලිමක් ඉදිරිපත් විමෙන් පසුව  බැංකු ගිණුමක් විවෘත කිරිමට සති දෙකක තුනක කාලයක් ප්‍රමානවත් බව ප්‍රකාශ කලේය.

 බැංකුවේ අකාර්යක්ශමවත් භාවය නිසා මෙහිදි අපහසුතාවයට පත්වුයේ මුත්තුය. 

තවද බැංකු ගිණුමේ සදහන් නම(“Harmil Singh Mattu, trading as Urban Suburban, re Bodill retention money account”.) එය විශ්වාසදායක බැංකු ගිණුමක් බවට තහවුරු කිරිමට ප්‍රමාණවත් නොවන බව ගරු අධිකරණය ප්‍රකාශ කලේය.

 අදාල මුදල් එම බැංකු ගිණුමට මාරු කරන ලෙසට, හැකි ඉක්මනින් බැංකුවට උපදෙස් ලබා දෙන බවටත්, බෝදිල්ව පැහැදිලිව හදුනාගැනිමට හැකිවෙන පරිදි  නම වෙනස් කිරිමෙන් එය විශ්වාසදායි බැංකු ගිණුමක් ලෙස පිහිටුවන බවටත් මුත්තු විසින් අධිකරණයට පොරොන්දු විය.
